Donation (Egg, Embryo, Sperm)
Florida Statute §742.14 permits and outlines the procedure for egg, sperm, or embryo donation. Once the genetic material (sperm, eggs, or embryos) is donated, the donor relinquishes all maternal or paternal rights and obligations to the donated materials and the resulting children. No court procedures are required.
Often, parties who are involved in known donations (where the donating party or parties know each other) opt for a simple contract to ease their minds and address any issues the parties may have.
When using a service and picking a donor (typically egg donors), the parties enter into a contract designed to control the actions of the donor, as well as the costs of the medical procedures, prior to the donation. Florida Statute §742.14 provides that women may donate their eggs for reasonable compensation directly related to the donation.
